This privacy policy ("Policy") of the Strike World game ("Game") outlines our practices in relation to the collection, storage, usage, processing, and disclosure of Personal Data (as defined below) which is collected via the mobile application ("App") and website at https://strike-world.com/ ("Website") (the App and Website are hereinafter collectively referred to as "Platforms"). The Platforms are owned and published by MIXI, Inc. (hereinafter referred to as "Company", "We", "Us", "Our").
This Policy applies to all visitors and users (including adults and children), and any other persons who access and/or use the Platform (hereinafter referred to as the "User", "You", "Your"). Reference to User, You, or Your in this Policy includes reference to any parent/guardian of a Child User (as defined below) or a PWD (as defined below).
Your privacy is important to Us, and We are committed to protecting your Personal Data (defined below) in accordance with this Policy. Therefore, please read this Policy carefully to understand how We collect, use, store, retain, disclose, share and otherwise process Your Personal Data in relation to access and usage of the Platform. The Policy applies to all Personal Data shared in digital form.
This Policy must be read together with the Platform's Terms of Use ("Platform Terms") available here at https://strike-world.com/terms-use/. If there is a conflict between this Policy, the Platform Terms or other policies of the Platform, the order of prevalence specified in the Terms shall apply.
By registering, accessing, or using the Platform or creating a user account, You confirm to Us that:
- (a) You have read the terms of this Policy which form a legally binding and enforceable contract between You and the Company. Such contract is formed when You register, (by clicking on the "I agree" button) on the Platform, or access or use the Platform;
- (b) Your consent is free, specific, informed, unconditional and unambiguous, and You are qualified to contract under applicable law;
- (c) You have the ability and authority under applicable law to share Your (or the Child User or a PWD's) Personal Data with Us, and permit Us to Process such Personal Data for the purposes mentioned in this Policy;
- (d) You are, at all times, responsible for Yours as well as any Child User and/or PWD's, of whom You are a guardian ("Guardian"), usage and activities on the Platform.
If You do not consent to the terms of this Policy, please do not use or access the Platform, and do not share Your Personal Data with Us.
This Policy is published in English. In the event You require Us to share this Policy in any local language, You may write to Us at support+terms@strike-world.com.
If You have any questions related to how this Policy applies to the Processing (as defined below) of Your Personal Data, please write to Our Grievance Officer (as defined below) at support+terms@strike-world.com.
1. Key Definitions
- (a) "Child User" shall mean any user below the age of 18 years.
- (b) "Data Protection Laws" mean and include any applicable law for the time being in force relating to the Processing of Personal Data of an individual in India.
- (c) "Grievance Officer" means the officer designated as a Grievance Officer as required under applicable Data Protection Laws, and as stated in this Policy.
- (d) "Personal Data" means any data about an individual who is identifiable by or in relation to such data.
- (e) "Process/Processing" means a wholly or partly automated operation or set of operations performed on digital Personal Data, and includes operations such as collection, recording, organisation, structuring, storage, adaptation, retrieval, use, alignment or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction.
- (f) "PWD" means persons with disabilities who cannot enter into a valid contract under applicable laws, or as defined under applicable laws.
2. Personal Data We Collect
- (a) We Process the following broad types of Personal Data when You access or use the Platform:
- Name
- Contact number
- Date of birth
- Age
- Location
- Device Information, including the type of network You are connected to, Your system language, and Your device's storage information
- Email address
- Name, phone number and email addresses of those in Your contacts list
- Social media account
- Advertising identifiers
- Error log
- Playing log
- (b) You are responsible to provide accurate, current, error-free and complete Personal Data, and shall keep Us informed if Your Personal Data changes during the period for which We hold it. We will not be liable for any errors, inaccuracies, or incompleteness in the Personal Data provided by You, or any direct or indirect consequences arising from such incorrect, inaccurate or incomplete Personal Data. If We find out that You have provided false Personal Data, We will be at liberty to restrict Your access to the Platform.
- (c) Please only share Your Personal Data, unless You have the written approval from any third parties to share their Personal Data, by contract or under applicable law. If You share any person's Personal Data with Us that is not Your own, you agree to inform such persons: (i) that their Personal Data may be Processed by Us; and (ii) of their rights regarding the Processing of their Personal Data in accordance with this Policy and applicable Data Protection Laws.
3. How We Collect Your Personal Data
We collect Personal Data in the following ways:
- (a) Directly from You: We collect Personal Data that:
- I.You enter on Our Platform, provided while creating an account with Us;
- II.You provide to complete surveys conducted by or for Us; and/or
- III.You provide when You elect to receive any communications (including promotional offers) from Us.
- (b) Automatically from Your browser type, internet protocol address used, Your usage patterns as collected by Our cookies. "Cookies" are tiny pieces of information which an application sends to Your computer. Cookies help Us personalize Your experience. You can change Your browser settings and choose to disable sharing of Personal Data through Cookies by choosing the "disable cookies" option in Your device setting, but this may limit the functionality of the Platform. Sometimes, tracking pixels, including but not limited to browser HTML pixels, may be used to collect Personal Data about a User's behaviour on the Platform. Pixels are tiny units which measure the digital images and graphics You see on an application. You agree that Cookies and pixels are used to improve Your experience as a User and consent to the use of the same.
- (c) Your use of the Platform in cases where You voluntarily provide certain Personal Data.
- (d) We may also collect Your Personal Data from third party sources with whom You have shared Your Personal Data with and have given them consent to share such Personal Data with us.
4. How We Process Your Personal Data
A. We may Process the Personal Data, inter alia, for the following purposes:
- (a) Verifying Your identity by using the contact details provided by You;
- (b) Providing You access to the Platform/user account;
- (c) Administration of Your user account on the Platform;
- (d) Enforcing the Platform Terms, this Policy, and engagement with Us including initiating legal, equitable, contractual claims and dispute resolution;
- (e) Contacting You and/or communicating with You;
- (f) Creation of a MIXI ID;
- (g) Enabling a customized experience for You on the Platform and providing You with a better and more efficient service;
- (h) Improving the Platform's design and style;
- (i) Developing new products, features, services, and functionalities;
- (j) Customizing in-Game rewards made available to You to purchase;
- (k) Customizing advertisements shown within the Platform;
- (l) Tracking Game patterns, Game-play interactions, and analysing trends of players to enhance Game-play experience;
- (m) Conduct surveys to improve user satisfaction within the Game;
- (n) Informing You about Our ongoing and upcoming offers and promotions, updates in relation to the Game, as well as sending marketing and other non-transactional information via notifications;
- (o) Addressing and resolving Your grievances;
- (p) Business management and internal purposes including maintaining data backups and security logs for accounting, auditing and complying with any statutory or regulatory reporting obligations;
- (q) Complying with and fulfilling any obligations under any law for the time being in force in India;
- (r) Detecting, preventing, investigating and deterring fraudulent, unauthorized or illegal activity;
- (s) Ensuring network and information security, including preventing unauthorised access to the Platform;
- (t) Sharing Personal Data with third parties for servicing You or any other purposes as discussed in Clause 5 (Who We Share Your Personal Data With) below;
- (u) Determining and preventing security breaches, computer containment or computer virus on the Platforms and Our systems;
- (v) In connection with a sale, transfer, merger consolidation or purchase of some or more of Our assets or businesses or in exploration of such transactions; and
- (w) Supporting internal processes for the above listed purposes.
B. We may also Process Your Personal Data without Your knowledge or consent for certain legitimate uses/purposes which are required or permitted by applicable Data Protection Laws. The circumstances of such legitimate use include:
- (a) Freely, when your Personal Data is made publicly available by You, or any third-party who is under a legal obligation to do so;
- (b) Enforcing any legal right or claim;
- (c) For a purpose (or reasonably incidental or ancillary purpose) for which You have voluntarily provided Your Personal Data;
- (d) Processing by any court or tribunal or any other body in India which is entrusted by law with the performance of any judicial or quasi-judicial or regulatory or supervisory function, where such processing is necessary for the performance of such function;
- (e) Processing in the interest of prevention, detection, investigation or prosecution of any offence or contravention of any law for the time being in force in India;
- (f) Fulfilling any obligation under any law for the time being in force in India to disclose any information to the state or any of its instrumentalities;
- (g) When necessary for a scheme of compromise, arrangement, merger, amalgamation, reconstruction, transfer of undertaking or division involving MIXI which has been approved by a competent court of law or tribunal, if applicable;
- (h) As may be necessary for research, archiving or statistical purposes in accordance with applicable Data Protection Laws;
- (i) Complying with any judgment or decree or order issued under any law for the time being in force in India, or any judgment or order relating to claims of a contractual or civil nature under any law for the time being in force outside India;
- (j) To assist any person during a disaster or breakdown of public order; and
- (k) Responding to a medical emergency involving a threat to the life or immediate threat to the health of the User(s) or any other individual.
In addition to Your consent recorded in here, from time to time, We may ask for specific consent to Process Your Personal Data for certain additional purposes.
5. Who We Share Your Personal Data With
The Company may share Your Personal Data with:
- (a) Affiliates: We may share Your Personal Data with Our affiliate entities who may need to access Your personal data for the purposes listed in Clause 4 (How We Process Your Personal Data) above or provide any services, managing risks, detecting fraudulent and unlawful activities, service level assistance, and administrative purposes.
- (b) Employees and consultants: We may share Your Personal Data with Our employees and consultants for the purposes listed in Clause 4 (How We Process Your Personal Data) above as well as for providing services to You in relation to the Platform.
- (c) Third-party service providers: We may provide Your Personal Data to Our third-party service providers, for servicing You in relation to Your use of or access to the Platform, or for any other purposes specified in Clause 4 (How We Process Your Personal Data) above.
- (d) Business transfers: If We are acquired by, or merged with, another company, or if Our assets are transferred to another company or as part of a bankruptcy, liquidation or insolvency proceedings, We may transfer Your Personal Data to such other company.
- (e) Law enforcement agencies: We may share Your Personal Data when compelled by any law enforcement agency in compliance with applicable laws.
All Our third-party service providers and other entities in the group are required to take appropriate security measures to protect Your Personal Data in line with Our policies and in accordance with the applicable Data Protection Laws. Our third-party service providers are not allowed to use Your Personal Data for their own purposes.
6. Child Users'/PWDs' Personal Data
- (a) We do not permit Child Users and PWDs to create an account on the Platform. A Child User and/or PWD creating an account on the Platform by providing false or fake information about their age will not be Our liability. Access to the Platform by a Child User and/or PWD is contingent upon the Guardians' explicit consent, including any in-Game purchases made by the Child User and/or PWD. All responsibility of monitoring and supervising access and usage of the Platform by a Child User and/or PWD is on the Guardians and We shall not be held liable for the same. If You discover that a Child User and/or PWD has created an account without the consent of their Guardian, please write to Us at: support+terms@strike-world.com and We will endeavour to take steps to: (i) cease Processing of the Personal Data of such Child User and/or PWD; or (ii) anonymise such Personal Data of such Child User and/or PWD.
- (b) While Child Users and/or PWD's may be able to access, and/or use the Platform by themselves, the use of the Platform by the Child User and/or PWD must be with the consent of the Guardian, and under the supervision of, a Guardian. If You are a Guardian, by allowing the Child User and/or PWD to access/ use the Platform, You confirm to having consented to Child User and/or PWD's use or access of the Platform and application of this Policy on the Child User and/or PWD's usage of the Platform.
7. MIXI ID1*
You may choose to create a MIXI ID, as detailed in Our Platform Terms available at: https://strike-world.com/terms-use/. For creation of the MIXI ID We will require You to share Your email address. The MIXI ID is used exclusively to link Your Game account with any in-Game items you purchase via any third-party online website(s)/webstore(s) ("Webstore") designated by Us. When purchasing any in-Game items via the Webstore:
1* This feature is not currently available to users and shall be made available as determined by MIXI, in its sole discretion. This does not represent any promise, commitment, or obligation of MIXI to deliver this feature.
- (a) Any personal or banking information You provide to the Webstore is governed solely by the Webstore's privacy policy and terms of use.
- (b) We do not collect, store, or have access to Your banking details, or any other Personal Data submitted by You to the Webstore.
- (c) The Webstore will share with Us only Your in-Game purchase history linked to Your MIXI ID, which we use to fulfil Your orders and provide customer support, if required.
8. Data Security
- (a) We take security of Your Personal Data very seriously and endeavour to implement and maintain physical, managerial, technical, organizational, and procedural safeguards to protect your Personal Data from any personal data breach, or unauthorized access, use, modification, disclosure, or destruction of Your Personal Data that You entrust with Us.
- (b) You agree that it is Your responsibility to control access to Your mobile device, the Platform and payment options connected to Your user account on the Platform. You also agree to keeping Your password(s) and/or PIN of Your mobile device, user account and the payment options connected to Your user account on the Platform confidential and not sharing it with anyone (including the Child User and the PWD). It is Your responsibility to alert Us if You believe that the security of Your Personal Data on the Platform has been compromised. If You suspect any misuse or loss or unauthorized access to Your Personal Data, please let Us know immediately by contacting Us by e-mail at: support+terms@strike-world.com.
9. Data Retention
We only collect and Process Your Personal Data as is necessary for the purposes and processing bases described in this Policy. We will retain Your Personal Data for the purposes it was collected for and in compliance with applicable Data Protection Laws. For further details on Personal Data retention, We request that You write to Us at: support+terms@strike-world.com.
10. Transfer of Personal Data Outside India
Your Personal Data may be transferred to group entities or third parties based and/or operating outside India. We will use appropriate safeguards to ensure that such data importer provides similar level of data protection that is provided by Us under applicable law, and that such transfer only happens for the purposes detailed in Clause 4 (How We Process Your Personal Data) above, or compliance with applicable Data Protection Laws.
11. Your Rights
We respect Your Personal Data and acknowledge Your rights in relation to it. Your rights in relation to access, rectify and withdraw Your Personal Data shared with Us are protected under applicable Data Protection Laws. To exercise any of Your rights above, please contact Us in writing, by emailing Your relevant Grievance Officer at: support+terms@strike-world.com.
You may withdraw Your consent without affecting the lawfulness of Processing based on consent provided to Us before its withdrawal by contacting Us at the address provided in this Policy. Any and all consequences of Your withdrawal of consent resulting in, inter alia, any inability by Us to comply with Our obligations vis-a-vis You, limitations, or termination of Your access to the Platform, will be borne entirely by You.
12. Your Duties
You must:
- (a) comply with the provisions of all applicable Data Protection Laws while exercising Your rights herein;
- (b) not impersonate another person;
- (c) not suppress any material information or provide any false information while providing Your Personal Data;
- (d) not register false or frivolous grievances or complaints with the Grievance Officer or Data Protection Board set up under applicable Data Protection Laws; and
- (e) furnish only such information which is verifiably authentic, while exercising Your rights.
13. Third-Party Links
- (a) The Platform may contain hyperlinks to various external websites, applications, content, advertisement ("Third-Party Links"). We do not own or control such Third-Party Links present on the Platform. If You choose to click on such Third-Party Links which direct You to a third-party website or application, You choose to do so at Your own risk. We assume no control or responsibility for the content, offerings, privacy policies or practices of such Third-Party Links or their services. You must read the privacy policy of such third-party website/application before You share any Personal Data on such website/ application.
- (b) You further acknowledge and agree that We are not liable for any loss of Your Personal Data as a result of the collection and/or disclosure of Your information through such third-party links, or as a result of any reliance placed by You on the completeness, accuracy or existence of any advertising, services or other materials on, or available through, such third-party links. This will include all transactions and information transmitted on such third-party links between You and any third-party websites/ application.
14. Reporting of Data Breach
In case of any data breach in relation to your Personal Data, We will take necessary steps to inform You/the authorities and take such steps as required to ensure compliance with the applicable Data Protection Laws.
15. Modifications
We reserve the rights to revise this Policy from time to time. The updated version of the Policy can be accessed at any time on the Platform. You are advised to regularly review the Policy. We will notify You of any major updates to this Policy that might materially affect the purpose of Processing Your Personal Data by means of a notice on the Platform or seek consent from You as required under applicable Data Protection Laws. You will be required to review the updated Policy. Your continued use of the Platform after any changes to this Policy will be deemed as Your acceptance of such change(s). If You do not accept the updated Policy, You may exercise Your right of withdrawal of consent as per Clause 11 (Your Rights) above. However, We may not be able to provide You access to the Platform in such case.
